This entry form describes the terms and conditions under which artwork is accepted for exhibit in the show defined above. Subject matter is ____________and may be of any material & medium. Deadline for submission is Wednesday, _______________.

Fees are based on membership status and a wall space of 36x40 inches as the basis for submitting work.

You can submit more than one piece – for example, 4 18x20 pieces of art will fit in the 36x40 wall space. Separation between work is not counted in submissions, but the art will be hung with spacing as determined by MOCA DC when it is hung for show.

Work larger than the 36x40 space may be submitted for an additional fee, which will be determined at time of submission.

Entry Fees for Non-Members:

You do not have to be a member of the gallery to exhibit work, except for member shows in April, August and December.

Senior rate is for 65 and older

Students are enrolled in college level courses and working toward a degree or vocational certificate

Commission for Sales: Work does not have to be for sale. A 20% commission applies to all sales.

All work must be signed and ready to hang. Work that is not signed will not be accepted.

Labels must be made for each piece and include artists name, title (or untitled), medium and price, or NFS if not for sale

Artist is responsible for costs getting work to gallery and back.

Pick up your work within 1 week of the closing date for the exhibit. Unless other arrangements are made with the gallery, work not picked up during this time WILL be disposed of by the gallery for storage costs.

By signing this form, artist declares that they have read and understand the Terms & Conditions below.

TERMS & CONDITIONS:

1. Artist hereby represents and warrants: (a) that he/she is the author of the Work(s); (b) that the Work(s) is/are original work(s) of
authorship; (c) that the Work(s) does not infringe or violate any rights whatsoever of any other person or entity; and (d) that the Artist has obtained any permissions, authorizations, waivers, releases, consents and/or licenses for any material included in the Work(s), including without limitation any model release(s) or that no such permissions, authorizations, waivers, releases, consents and licenses are required.

2. Artist hereby grants to MOCA DC (the “Gallery”) an irrevocable, royalty-free, non-exclusive license to use the Artist’s name, likeness and biographical information as well as photograph(s) of the Work(s) (collectively, the “Artist’s Material”); such license shall include the rights to reproduce, distribute, transmit, adapt, publicly display and publicly perform Artist’s Material including as part of a CD Compilation (the “Compilation”) containing digital images and video of the Work(s) exhibited, photographs and video of the Artists exhibited and a biographies of the Artists exhibited. Copies of the Compilation shall be offered for sale by the Gallery. Nothing herein shall create any obligation on the part of the Gallery to use any of the Artist’s Material.

3. All right, title and interest in and to the Compilation shall be the sole property of the Gallery. In this connection, the Gallery shall have the exclusive rights throughout the world to register the copyright in the Compilation and to secure any and all applicable renewals and extensions of such copyright. All right, title and interest in and to the Artist's Material (including, without limitation, all worldwide copyrights therein,) is and shall remain the property of the Artist.

4. The determination of the price of the Work(s) shall rest solely with the Artist.  The Gallery will not provide any recommendations with respect to price of the Work(s). The Gallery shall retain twenty percent (20%) of the revenues received by the Gallery for the sale of any work(s) and shall pay eighty percent (80%) of such revenues to the Artist.

5. The Gallery shall take reasonable steps to ensure the preservation and safekeeping of the Work(s); notwithstanding the foregoing, the Gallery disclaims any liability for any loss or damage to the Work(s) while in the possession of the Gallery.
